CAMPAIGN RULES
ORDER TICKETS FOR "NEVERSEA" FESTIVAL, 2023 edition

I. PREAMBLE
The campaign "Order in installments tickets to the Neversea Festival, 2023 edition" which will take place on 6-9 July 2023 (hereinafter "the Festival"), is organized by the company NEVERSEA S.R.L., a Romanian legal entity, with headquarters in Cluj-Napoca, str. Eremia Grigorescu, nr. 122A, Jud. Cluj, registered at the Trade Register under no. J12/183/2017, C.U.I. RO 3694434, and applies to persons (hereinafter "Client") who:
- hold a valid account in the "Extasy" application or Extasy platform;
- pay the price of the Festival pass (hereinafter referred to as "Ticket"), in instalments, via the Extasy App or on the website www.extasy.com, online, with a bank card;

At the time of entry you accept sole responsibility for deciding whether your participation is legal under any jurisdiction applicable to you. By entering the Campaign, you agree to these Rules and to the fact that the decisions of the Organizer are final and binding with respect to the Campaign.

Online payment by bank card is the easiest and quickest method of payment, which is why Customers who are holders of a credit or debit card of any kind (e.g. VISA, Mastercard) can purchase a ticket/tickets for participation in the Festival, with payment to be made in a maximum of seven instalments, as follows.

These Regulations contain the provisions that each Customer undertakes to observe and to which he/she declares his/her agreement.

The Rules are available free of charge to any Customer in the Extasy App and on the website www.extasy.com.

II. RIGHT OF PARTICIPATION
Any natural or legal person, resident in Romania, with full legal capacity, who purchases a ticket/tickets during the period mentioned below, within the limits of the available stock of the Organizer, may participate in this campaign.

III. CAMPAIGN PERIOD AND LOCATION
The campaign will run on the Extasy App and on the website www.extasy.com, from 22.11.2022 to 15.06.2023.

IV. INFORMATION ON THE PRODUCTS INVOLVED IN THE CAMPAIGN AND THE CAMPAIGN MECHANISM
Any natural or legal person who places an order for one of the Festival passes can enjoy the payment of the price in instalments.
The subscriptions that can be purchased in instalments are:
Standard General Access Basic subscription - guarantees the Customer access to the Festival for the entire duration of the Festival, from the first day until the end of the Festival.
Standard Risk free subscription - guarantees the Client access to the Festival for the entire duration of the Festival, as well as the right to a refund in case of no-show, according to the conditions set by the Organiser.
V.I.P. - guarantees the Client access to the Festival for the entire duration of the Festival, from the first day until the end of the Festival. VIP Pass holders are granted access to a specially designed bar area with premium drink options.
The VIP pass is for people over 18 years old.

Each person can order as many tickets as they wish, with the number of instalments in which the price can be paid being determined by the exact date of ordering the ticket:
● Tickets to be purchased in November, 2022, will be payable in a maximum of 7 (seven) instalments. The first instalment for the first instalment + the 50 lei fee requested by Extasy for processing the order will be paid at the time of the order, and the following instalments can be paid within a maximum of 30 days, calculated from the date of the Customer's last payment.
● Tickets to be purchased in December 2022 may be paid in a maximum of 6 (six) instalments, the first instalment for the first instalment + the fee of 50 lei requested by Extasy for processing
order, will be paid at the time of the order, with subsequent instalments payable within a maximum of 30 days, calculated each time from the date of the Client's last payment.
● Tickets to be purchased in January 2023 may be paid in a maximum of 5 (five) instalments, the first instalment of the first instalment + the 50 lei fee requested by Extasy for processing the order will be charged at the time of ordering the ticket and the following instalment will be paid within a maximum of 30 days from the date of the last payment by the Customer.

● Tickets to be purchased in February, 2023, can be paid in a maximum of 4 (four) instalments, the first instalment of the first instalment + the 50 lei fee requested by Extasy for processing the order will be charged at the time of ordering the ticket, and the next instalment will be paid within a maximum of 30 days from the date of the last payment by the Customer.
● Tickets to be purchased in March 2023 may be paid in a maximum of 3 (three) instalments, the first instalment of the first instalment + the 50 lei fee requested by Extasy for processing the order will be charged at the time of ordering the ticket and the next instalment will be paid within a maximum of 30 days from the date of the Customer's last payment.
● Tickets to be purchased in April 2023 may be paid in a maximum of 2 (two) instalments, the first instalment of the first instalment + the 50 lei fee requested by Extasy for processing the order will be charged at the time of ordering the ticket and the next instalment will be paid within a maximum of 30 days from the date of the Customer's last payment.
● Tickets to be purchased in May 2023 may be paid in a maximum of 1 instalment, the first instalment of the first instalment + the 50 lei fee requested by Extasy for processing the order will be charged at the time of ordering the ticket and the next instalment will be paid within a maximum of 30 days from the date of the Customer's last payment.

● Tickets purchased after June cannot be paid for in instalments and must be purchased in one instalment.

Once the order has been placed, each person will receive a confirmation e-mail.

Extasy will try to debit your account with the price of the instalments according to the terms mentioned above. If it is not possible to debit your account, for any reason and for any payment instalment, the ticket will not be considered as purchased and Extasy will cancel it from the system, so you will not be allowed access to the Festival, and amounts previously paid (whatever their number) cannot be recovered and will remain the property of the Partner).
It is your responsibility to make sure that you have the amount of each payment instalment in your account so that the debit can be made validly and on time.

Thus, by ordering your subscription(s) you agree to the automatic debiting of your account by Extasy with the price of the subscription(s) ordered! Withdrawals will be made from your card, with which you registered in the Extasy App or on the website www.extasy.com.
The delivery of the subscription(s) ordered and paid for will be made online to the Clinet account in the Extasy App/Extasy website.

In the event of failure to withdraw the amount of the ordered subscription(s) from the Customer's card, the ordered subscription(s) will not be considered as purchased.

V. GENERAL CONDITIONS
The Organiser reserves the right, at its absolute discretion, to disqualify any person who tampers with the registration or operation of the Campaign, who violates these Rules, who acts in an unethical or disruptive manner or who is determined to be acting with intent to annoy, abuse, threaten or harass any person. The use of fraudulent methods of entering the Campaign in any manner will result in the cancellation of all registrations by such methods, and persons using such methods will be disqualified. If, for any reason, this Campaign cannot be run as planned
due to causes beyond the control of the Organiser/Extasy, fraud, technical problems, or any other causes which, in the opinion of the Organiser/Extasy, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Campaign, the Organiser reserves the right to cancel, terminate, modify or suspend the Campaign. In the event that the Campaign is terminated due to force majeure, fraud or technical difficulties before the end of the Campaign Period, an official announcement will be made.

VI. LIMITATION OF LIABILITY
In no event will the Organizer be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages, arising out of your participation in this Campaign. Without limiting the foregoing, the products and services offered by the Organiser, including this Campaign, are offered "as is", without warranties additional, express or implied, to those which the Organiser is required by applicable law to give.

VII. LEGISLATION AND LITIGATION
This Regulation is governed by Romanian law. If one of the clauses is declared void, the other clauses will not be affected and will continue to be valid and enforceable under Romanian law. Any dispute arising from these Rules shall be settled by the competent courts of the Organizer's headquarters.

VIII. FORCE MAJEURE
Force majeure is any event that cannot be controlled, remedied or foreseen by the Organizer, including the impossibility of the Organizer, for reasons beyond its control and whose occurrence determines its inability to fulfill its obligations under these Rules. If the above situation occurs or any other situation of force majeure occurs that prevents or delays the execution of the Rules or the continuation of the Campaign, the Organizer shall be exempt from liability for the fulfilment of the obligations for the period during which the fulfilment of the obligations is prevented or delayed according to the law.

IX. TERMINATION OF THE CAMPAIGN
This Campaign may be terminated in the event of an event of force majeure or in the event of a change in the legislative framework such that the organisation and running of the Campaign requires an increase in the budget allocated to this project.

X. LEGAL BASIS
This Regulation is in accordance with the provisions of national legislation on the marketing of products and services, namely Government Ordinance no. 99/2000 and the legislation on the protection of individuals with regard to the processing of personal data and the free movement of such data. Complaints about products or services involved in the Campaign after the end of the Campaign in accordance with these Rules will not be considered and will not represent the responsibility of the Organizer. In case of attempt or fraud of the Campaign system, abuse or any facts affecting the image of the Organizer, the Organizer reserves the right to take all necessary measures to remedy the situation. The Organizer will take all necessary measures to run the Campaign in normal conditions as described above, but does not assume responsibility for complaints, disputes of participants that are not aimed at violating the legal framework in force.


PRE-ORDER Neversea CAMPAIGN 2023

Campaign validity period: 27.10.2022 - 21.11.2022 (23:59 EET).
Through the pre-order campaign, you can secure your festival ticket at a special price with: 1 EURO/ticket. The price of 1 EURO can only be paid by card, the purchase of the package with coins will be considered invalid and participation in the campaign will be restricted by the coins payment method. In case of payment with coins, the purchase will be cancelled and a refund will not be possible.
*You can add a maximum of 4 products to your cart.

IMPORTANT: Paying 1 EURO does NOT guarantee participation in the Neversea 2023 festival, nor will you receive the festival ticket.

In order to get the festival ticket, it is mandatory to pay the full value of the chosen ticket, as follows:
For General Access Basic - 4 days pass - you will pay 1 euro when placing the pre-order and 79 euro + taxes, on November 22, through the automatic card withdrawal mechanism.
For General Access Risk-Free- 4 days pass type - you will pay 1 euro when placing the pre-order and 99 euro + taxes, on November 22, through the automatic card withdrawal mechanism.
For VIP- 4 days pass - you will pay 1 euro when placing the pre-order and 209 euros + taxes, on November 22, through the automatic card withdrawal mechanism.
By purchasing this product, you agree to the withdrawal of the amount with the remaining amount per ticket, from your bank account registered in the Extasy App / Extasy.com, on 22.11.2022.
Your card will be withdrawn in several phases to ensure your order is completed. The first withdrawal phase will take place on 22.11.2022, at 11:00, 13:00, and 17:00. If the first draw phase fails, the second phase takes place on 25.11.2022 at 11:00. If withdrawal has failed up to this point, there is one last attempt on 29.11.2022 at 11:00 AM.

IMPORTANT: If the withdrawal operation cannot be completed in any of the above cases, then the order is canceled and you will NOT receive your festival ticket for Neversea 2023.

CANCELLATION:
If you want to cancel your order you must send an email to the address: support@extasy.com by 21.11.2022.
The first payment (1 euro paid) will NOT be refunded.

By accepting the Extasy Terms and Conditions, you agree and accept the provisions of the Regulations for organizing and conducting the campaign of our Partner NEVERSEA SRL.
