GENERAL TERMS AND CONDITIONS “MASSIF” - WINTER FESTIVAL
EVENT: MASSIF FESTIVAL

DATE OF THE EVENT: 14-17 March 2024
I. GENERAL PROVISIONS
1.1 The General Terms and Conditions (hereinafter referred to as GTC) apply to the organization and conduct of the MASSIF - WINTER FESTIVAL event (hereinafter referred to as the Festival), organized by MASSIF ESTATE S.R.L., VAT number: 45318331, registered with the Trade Register under no. J12/5924/07.12.2021, (hereinafter referred to as the Organizer) and contain the provisions which each participant commits to comply with.
1.2 By purchasing a ticket or by attending the Festival, the Participant declares to have read and understood and undertakes to comply with the GTC, which also include the Privacy Policy and the Cookies Policy, which can be read by accessing www.bemassif.com.
1.3 The General Terms and Conditions are valid indefinitely. The Participants agree that MASSIF ESTATE has the right to unilaterally amend these GTC, without need for previous notification. Should the GTC be amended, the respective amendments shall take effect immediately after publication on the Website. MASSIF ESTATE stipulates that the GTC can be amended after the purchase of the Ticket, even right before the Festival. MASSIF ESTATE S.R.L. recommends Participants to monitor the changes to these GTC.
II.DEFINITIONS
2.1. During their use in this document, the defined terms have the meaning agreed in this section, unless they are otherwise defined in this document:
Ticket: A certificate issued in any form (on paper or in electronic form), one-day ticket, pass/subscription or invitation attesting the right to receive a wristband at the Festival organised by MASSIF ESTATE SRL. Tickets are non-nominally or nominal and have a unique identification number. By purchasing or transforming vouchers/products into Tickets, buyers undertake to comply with these General Terms and Conditions, the procedures for registering purchased Tickets, the rules of online check-in and access to the Festival, as well as, in general, any other rules of participation that are brought to you, through various means, including directly through the Website. The purchase of Tickets from areas other than those authorized by the Festival Organizer is prohibited and restricts access to that Festival
Wristband: a certificate applied by MASSIF ESTATE S.R.L. when validating a Ticket, which offers rights identical to those included in the Ticket and – provided it is secured according to provisions below – it only certifies that its holder has the right to visit the respective Festival; It is also a special payment instrument within the Festival.
Ticket Buyer: the person who buys the Ticket at the Festival.
Duration of the Festival: the period between the beginning and the end of the Festival, according to the dates and times mentioned by the Organizer in TCG.
Events - MASSIF FESTIVAL
Festival – The ”MASSIF - WINTER FESTIVAL”, made up of all the performing arts programs - music, entertainment and culture - with varied program and festive character, which takes place between 14-17 March 2024.
Organizer / MASSIF ESTATE – MASSIF ESTATE SRL, a Romanian company, with headquarters in Cluj-Napoca, General Eremia Grigorescu street, nr. 122A, Cluj Country, Trade Register Registration Number J12/5924/07.12.2021, VAT number 45318331.
Contractual Partner: an economic operator or other natural/ legal persons who carries out independent commercial activities at a certain Festival, based on a contractual relationship with the Organizer.
Participants: all persons participating in the Festival, whether they are Authorized Participants or are Unauthorized Participants.
Product: the elements and the rights with pecuniary value that can be purchased form the Organizer or other Contracting Partners within the Festival or in connection with it, as well as any vouchers or other similar means that can be offered in exchange for them.
Service: any service provided by the Organizer or its Contracting Partners within the Festival or in connection with it, either free or paid.
Site: MASSIF website, respectively www.bemassif.com.
TCG : These General Terms and Conditions governing the conduct of the Festival, available both on the Site (as defined above) and at all entries in the Festival Area.
Third parties: individuals and legal entities other than the Organizer, ticket buyers or authorized participants.
Festival area: any of the locations where the Festival takes place.
III.LEGAL RELATIONSHIP
3.1 These TCG also present the obligations arising from participation in the Festival and the relations established between MASSIF and Participants during the Festival, the latter being obliged to comply with them, the application of the TCG reaching the guarantee of the safety and comfort of the TCG.
3.2. The TCG should be read in conjunction with the Privacy and Cookie Policy. The TCG will be posted both on the www.bemassif.com website and at the entrance of the Festival.
3.3. These TCG set out the rights and obligations arising from the receipt of an Order Confirmation, the purchase of Products and participation in the Festival and the relationship established between Massif and the Buyer and Participants.
3.4. By purchasing Products or participating in the Festival at the Festival, Product Buyers and Participants accept and agree to comply with:
TCG and any related obligations and responsibilities. Any Product Buyer and Participant who violates the TCG may be liable for legal action, denial of entry to the Festival and/or removal from the Festival perimeter.
security measures, notices, requests or announcements displayed or given by the Police, Security Personnel or agents representing any of the Associated Entities, including without limitation, all instructions or announcements regarding access and security to the Festival;
all national laws and regulations.
3.5. The Buyer and the Participant agree to indemnify the Promoter for any damages, losses, liability or injury that such parties suffer or may suffer as a result of the failure of the Buyer and the Participant to comply with these T&Cs.
IV.TICKET CATEGORIES
4.1 Visitors are admitted to the Festival at the times and according to the conditions specified by the organizer in this regulation. By purchasing a valid Ticket each Participant acquires the right to participate in the Festival, having the obligation to know their rights and obligations within it.
4.2 Participation at the Festival shall be made by using one of the Following types of Tickets:
A. Standard Passes (General Access) - guarantee the Authorized Participant access to the Festival for the entire duration of it, according to the daily schedule announced by the Organizer, as well as to the Apres Ski area between 10.00-17.00 (for the upper areas) and 12.00 -22.00 (for the areas at the base of the slope).
B. VIP subscriptions - guarantee the Authorized Participant access to the Festival for the entire period of its duration, according to the daily schedule announced by the Organizer, as well as to the Apres Ski area between 10.00-17.00 (for the upper areas) and 12.00-22.00 (for areas at the base of the slope). VIP membership holders have access to a specially designed bar area with premium drink options. Access to the Festival for VIP season ticket holders is through a special entrance.
Important! The access of persons under 18 to the VIP area is strictly prohibited. The Contractual Partners who operate the VIP platforms will be able to establish differentiated access conditions on the platform, depending on the services offered by the Partner and paid by the consumer.
C. One-day tickets – guarantee the Authorized Participant access to the Apres Ski area between 10.00-17.00 (for the upper areas) and 12.00-22.00 (for the areas at the base of the slope), as well as to all the Festival stages on that day, according to the schedule announced by the Organizer for that day. At the closing time of the Festival day, when the Ticket expires, and the Participant no longer has access to the Festival.
D) UNDER 25 Passes - guarantees access to the Festival for the entire period of its duration to the Participant who meets the conditions of the "UNDER 25" program.
Products from the Under 25 Program are dedicated to and available only to people who meet the following conditions:
The person purchasing this subscription has not reached the age of 25 on the first day of the Festival;
Is enrolled in a form of education in Romania and can prove enrollment in a form of education in Romania by presenting a document attesting to this fact (booklet, certificate, etc.) and the identity card to be able to verify the person's name and age .
At the time of the festival, the buyer of the subscription will present himself at the point marked "Credentials", located within the festival, from where he will directly pick up his festival participation wristband by presenting his identity card and card or certificate proving his pupil/student status ( the certificate from which the Personal Numerical Code (CNP) will be deleted by any method that ensures the indecipherability of the CNP, for example erasing it with a marker).
If the owner of the purchased Under 25 season ticket cannot prove that he is eligible, he will pay the difference between the full price of the season ticket (which is 149 Euros for General Access) and the price paid for the season ticket within the promotion. Otherwise, access to the perimeter of the Festival will not be allowed.
These subscriptions are offered on a program basis and are subject to availability. Prices are displayed in the Tickets section of the website.
E. "BRASOVISA" Passes - guarantees access to the Festival throughout its duration for the Participant who meets the conditions of the "BRASOVISA" program.
The products within the BRASOVISA Program are dedicated and available only to individuals who meet the following conditions:
The person purchasing this type of subscription has a home address registered in the identity card in Brașov or Prahova county or has obtained residency in Brașov or Prahova county.
The person purchasing this type of subscription can prove their home address or residency by presenting a document attesting to this fact through the identity card or residency visa.
At the time of the festival, the subscription buyer will present themselves at the designated "Access" point within the festival, where they will collect the participation bracelet by presenting the subscription and the identity card or residency visa for home address or residency verification.
If the holder of the purchased BRASOVISA pass cannot demonstrate eligibility, they will pay the difference between the full price of the subscription and the price paid for the subscription within the BRASOVISA program. Otherwise, access to the Festival area will not be allowed.
These subscriptions are offered based on a program and are available while supplies last. Prices are displayed in the Tickets section on the website.
TYPES OF INVITATIONS
4.3. Participation in the Festival can also be made using one of the following types of invitations (which will be considered similar to Tickets):
A. Standard Invitations (General Access) - guarantees the Authorized Participant access to the Festival for the entire period of its duration, according to the daily schedule announced by the Organizer, as well as to the Apres Ski area between 10.00-17.00 (for the upper areas) and 12.00 -22.00 (for the areas at the base of the slope).
B. VIP Invitations - guarantees the Authorized Participant access to the Festival for the entire period of its duration, according to the daily program announced by the Organizer, as well as to the Apres Ski area between 10.00-17.00 (for the upper areas) and 12.00-22.00 (for areas at the base of the slope). VIP membership holders have access to a specially designed bar area with premium drink options. Access to the Festival for VIP season ticket holders is through a special entrance.
Important! The access of persons under 18 to the VIP area is strictly prohibited. The Contractual Partners who operate the VIP platforms will be able to establish differentiated access conditions on the platform, depending on the services offered by the Partner and paid by the consumer.
C. One-day invitations – guarantees the Authorized Participant access to the Apres Ski area in the time interval 10.00-17.00 (for the upper areas) and 12.00-22.00 (for the areas at the base of the slope), as well as to all the Festival stages on that day, according to the schedule announced by the Organizer for that day. At the closing time of the Festival day, when the Ticket expires, and the Participant no longer has access to the Festival.
4.4 The buyer of tickets / subscriptions has the obligation not to display online images of the tickets / season tickets purchased. A ticket / subscription provides access for one person to the Festival.
4.5 It is strictly forbidden to sell or buy invitations.
4.6 We encourage people who enter the Festival Area using an invitation to donate a sum of money (in the places that will be reported for this purpose), an amount that will be used for charitable purposes, described in the specially arranged locations.
4.7 The organizer reserves the right to change the list of artists participating in the festival, both before and throughout the Festival. Tickets / season tickets purchased to participate in the Festival provide access to the buyer in the Festival area, and do not guarantee access to a particular concert, artist, entertainment or service.
4.8 Each location, within the scope of the festival, has a limited capacity and access may be temporarily restricted to meet the safety regulations in force.
4.9 Standard tickets / subscriptions can be modified into VIP tickets / subscriptions, with the payment of a price difference, within the limits of the available stocks.
4.10 In the case of the price of a note expressed in EURO, the reference exchange rate was set at 5.0000 lei as of 08.08.2023, at 08:52:24, of Banca Transilvania.
4.11 The Organizer reserves the right to change the exchange rate and the price of Tickets without the need for prior notification. Changing the ticket price does not apply to tickets already purchased at the time of the change.
4.12 It is strictly forbidden to transmit or post a unique series of tickets and / or subscriptions on social networks or other websites of this kind (e.g Facebook, OLX).
4.13 Failure to comply with these provisions will result in the cancellations of the commercialized invitations/tickets and the prohibition of access to the festival by the responsible persons.
4.14 IMPORTANT! It is strictly forbidden to sell or buy invitations and it is not recommended to buy tickets or season tickets except through authorized ticket sales platforms ( www.extasy.com, or any other authorized platforms, called Contractual Partners).
THE ORGANIZER CANNOT GUARANTEE THE VALIDITY OF ANY TICKETS THAT ARE NOT PURCHASED THROUGH THESE CONTRACTUAL PARTNERS. IF ANY TICKET FRAUD IS DISCOVERED, THE ORGANIZER RESERVES THE RIGHT TO CANCEL THAT TICKET AT ANY TIME.
The organizer draws attention to the fact that there is the possibility of a series of frauds arising from the sale of tickets through unauthorized channels, and in this case the consumer assumes the risk of purchasing a ticket that will not allow him access to the Festival.
The Organizer reserves the right to resort to legal means to sanction those who will be found to carry out such activities, as well as to cancel the respective Tickets / Subscriptions.
4.15 Tickets and / or subscriptions purchased may be used for commercial purposes, such as for organizing promotional campaigns, offering tickets and / or season tickets as prizes for competitions, etc., only with the prior written consent of the Organizer. Failure to comply with this obligation will result in the cancellation of tickets and / or season tickets used for commercial purposes and the obligation of the persons responsible to repair the damage thus created. At the same time, the organization of promotional campaigns by using the tickets and / or subscriptions to the Festival, without the prior written consent of the Organizer, constitutes an infringement of the intellectual property rights regarding the Organizer's trademark.
CONTRACTUAL PARTNERS
4.16. Tickets are not sold directly to buyers by the Organizer, and their payment is not processed directly by the Organizer. The ticket authorizing the participation in the Festival is sold to the buyer of the In-Town platform, Entertix, Extasy or other contractual partners of the Organizer. All payments are made through the Contracting Partners. The organizer only guarantees the validity of the tickets sold through the networks of these Contractual Partners.
4.17. Additional information regarding the detailed conditions applicable to the purchase of Tickets online or in physical format will be provided by our Contracting Partners when purchasing the goods.
4.18. Our Contractual partners sell Tickets at fixed locations, on the ticket purchase interfaces online.
4.19. At the time of purchasing the ticket, the buyer will have to provide the following personal data: name and surname, date of birth, sex, email, city and country of residence.
4.20. Tickets accepted by the Organizer that have been purchased from the Contractual Partners can be either in physical hardback format or in electronic format (eTickets) which are sent to you as an attached PDF or QR code in an email that each The Participant has the obligation to print it and bring it with him to the event, or present the original ticket in electronic format (on a phone, tablet or other electronic devices that allow this) when checking in on site. Careful! Pictures taken with physical or electronic tickets are not accepted! Most Contractual Partners customers receive PDF tickets within 3-5 minutes after payment is successfully completed. If your ticket has not arrived by e-mail after 24 hours from placing the order, you must contact the platform from which you purchased the ticket within 10 days of purchasing the ticket, but no later than one day before the start of the Festival. MASSIF is not responsible in any way for this kind of situations, and in the absence of a valid ticket, access to the Festival will not be allowed.
OTHER TAXES AND SERVICES RELATED TO TICKETS
4.21.1. The final price paid by the Buyer will consist of the base price of the ticket and in addition it will also include the administration and processing fees, the Red Cross stamp fee, the fees for the collective management bodies.
4.21.2. The Organizer is not responsible for the administration and processing fees that may differ depending on the platform from which the tickets are purchased and the Contractual Partners from which the consumer / buyer purchases the goods. The Organizer can not be held responsible for extra services offered by Contractual Partners.
RISK FREE CHARACTERISTICS
4.22.1. The additional “Risk Free” service is provided by the Organizer, who undertakes to return the value of the access ticket / subscription to the buyer, in case the buyer meets all the following conditions:
i) requests the reimbursement of its equivalent value, in case it cannot be presented at the Festival, within the term provided in art. 4.22.2;
ii) the buyer opted for this service together with the purchase of the ticket / subscription and paid the related fees.
4.22.2 The buyer can request the return of the equivalent value of the purchased “Risk Free” ticket / subscription at any time, but not later than 14 days before the start of the Festival.
4.22.3 The Organizer undertakes to return exclusively the value of the ticket, without the “Risk Free” fee (set by the Organizer at the amount of 10 EURO or another amount, but not more than 25 EURO) within a maximum of 30 days from the time of the request, if the request was made in time (according to 4.22.2).
4.23 Except for the situations provided in art. 4.22.1, 4.22.2. And 4.22.3, the money on the Tickets purchased for the Festival will not be refunded if the buyer does not want to attend or cannot attend the Festival for any reason. Loss of the Ticket leads to the loss of the right to participate in the Festival as the purchase of services regarding leisure activities, if a specific execution date is provided, is exempted from the application of the right of withdrawal regulated by GEO 34/2014.
4.24 The organizer does not assume responsibility for the loss or theft of the ticket and / or season ticket. The organizer has no obligation to refund the money or replace the ticket and / or season ticket in case of loss or theft of the ticket and / or season ticket.
V. LIMITATION OF LIABILITY
V.1. LIMITATION OF THE ORGANIZER'S LIABILITY
5.1 The Organizer, collaborators, contractual partners of the Organizer cannot be held liable for direct or indirect damages resulting from access to the perimeter of the Festival or from the purchase or use of services or products made available within its perimeter. Participants understand and agree to participate in the Festival at their own risk.
5.2.Participants understand and agree that the structure and content of the Festival is presented without any guarantee of any kind.
5.3 Information on events, activities, concerts, artistic events organized, hosted or promoted by the Organizer is provided for informational purposes only and should not be construed as a contractual offer of the services provided by the Organizer. The organizer can make changes to the program (artistic, organizational, etc.) unilaterally, depending on various situations that may arise along the way.
5.4 The organizer makes every effort to ensure that the information presented on the website, on social media channels, in the press and through other public media is accurate and up to date. If any errors are reported, the Organizer will try to correct them as soon as possible.
5.5 The Organizer guarantees access to and use of the location services to any Participant who has a valid ticket. The dates of the concert may be modified unilaterally by the Organizer in accordance with the provisions of the T.C.G.
5.6 The organizer reserves the right to change the hours of the music program. The Participant has no right to claim compensation in the event of such changes, respectively, the Participant may not sue the Organizer in the event of a change in the music program.
5.7 The organizer excludes liability for damage to the premises of the Festival, which was not the cause of a faulty organization or negligence.
5.8 The organizer is not responsible for actions that take place outside the perimeter of the Festival.
5.9 The organizer does not give the participants any guarantee regarding the possibility to enter the Festival at the opening time announced or desired by them (the desired time for the timely participation in a certain concert), or regarding the quality of the fun. Any request to reimburse the value of the ticket, to grant a reduction or payment of damages, indemnities or compensations of any kind on this basis is excluded!
5.10. The organizer reserves the right to modify, restructure and further develop the Festival, the services and products offered within it, at its choice, depending on needs. Participants have no right to make any claims against the Organizer or to request a refund of the ticket value as a result of any subsequent changes, restructuring or development.
5.11. The organizer will not guarantee the participant the availability, content, quality and quantity of programs and services (such as the evolution or appearance on stage of a particular artist, the fact that the evolution of a particular artist will live up to the participant's expectations, or the opportunity to participate in a certain artistic program and / or at a certain location). These elements can take shape depending on the special characteristics of the location, the extraordinary situations that have occurred and the equipment that is present in them (such as the number of seats of a certain location).
However, the Organizer will make every effort to provide previously announced entertainment, concerts and services and, if they become impossible or extremely difficult for the Organizer, will endeavor to replace the entertainment, concert or services provided. with similar ones.
5.12. Participants acknowledge and expressly agree that they may also purchase products and services related to the Festival that are offered by other contractual partners, and not by the Organizer. In such cases, the contract is concluded directly between the participant and the contractual partner, and the rights and obligations arising from the legal relationship apply exclusively to the participant and the contractual partner.
5.13. Participants acknowledge and expressly agree that they may not raise any claim against the Organizer in respect of those products and services or in connection with the contract for those products and services.
5.14. The Organizer will be solely liable for intentional breaches of contract directly attributable to it and breaches of contract that endanger human health, integrity or physical health, if such damage is caused solely and directly by the Organizer, and could not have been prevented by Participant by submitting due diligence in this regard.
5.15. Lost and found items can be handed over to the information desk indicated on the map. Participants may inquire about lost items at the same office.
5.16. Participants are fully responsible for any damage they have caused to the Organizer, its contractual partners or any other participants in the Festival and for any damage, regardless of their nature, in connection with the Festival.
5.17 The organizer has the right to immediately terminate the legal relationship with the participant or buyer who has violated any provision of these T.C.G. in connection with the Festival. In such a case, the Organizer may invalidate the ticket of the participant from the system or cut his bracelet, and the participant will be forced to leave the Festival. Also, the Organizer will have the right to refuse the purchase of a new ticket by the participant or the respective buyer, for the entire duration of the Festival. If the participant or the buyer obtains a ticket to the Festival, the Organizer will have the right to refuse his access to the Festival premises, without granting him any right of compensation. Under no circumstances will the Organizer be liable in any way to the buyer or participant, nor will it be liable for any damages incurred.
5.18. The participant agrees to be granted the medical treatment that may be considered appropriate in case of injury, accident or illness during the Festival and exonerates the Organizer from any liability for any such actions. In the Festival Area, first aid services and medical assistance will be provided continuously. The organizer is not responsible for how these services are provided.
5.19. During the Festival there will be various games of high intensity lights and pyrotechnic effects that can harm children or people with epilepsy. Participants suffering from mental and physical illnesses and who may be affected by any loud noises, special visual effects, crowded areas , special sound effects or any other such, assume full responsibility for any damage you may suffer.
5.20. The organizer is not responsible for any damage or injury that may result from fireworks or any entertainment. Participants assume full responsibility for participating in such moments.
The organizer is not responsible for any damage or injury that may occur as a result of activities carried out on the slopes or any type of activities specific to winter sports. Participants assume full responsibility for participating in such activities.
IMPORTANT! We recommend performing specialized medical check-ups before participating in activities that require a high level of effort.
5.21. The organizer does not assume responsibility for damages arising from or suffered in connection with the purchase or use of Services and Products provided by Contractual Partners or for damages of any nature suffered by visitors as a result of participating in artistic moments or subsidiary activities within the Festival .
V.2. CANCELLATION OR POSTPONEMENT OF THE FESTIVAL.
5.21 Cancellation due to fault of the Organizer. In case of cancellation of the Festival due to reasons solely the fault of the Organizer, the contractual partners on the site from which the buyers purchased the Tickets will refund the price of tickets paid by the buyer, within 30 days from the date of cancellation.
5.22 Cancellation due to force majeure event. The equivalent value of the purchased tickets will not be refunded in case of cancellation of the Festival by the Organizer due to force majeure event. Force majeure means any external and unpredictable event such as, but not limited to: storms, threats or risk of terrorist attack, acts of public authorities, whether legitimate or not, epidemics, pandemics, accident, explosions, fires, floods, torrential rains, earthquakes, social conflicts, major short circuit, high risk of damage to health or any other cases that cannot be foreseen or removed by diligence and caution by the Organizer. In this case, the date of the Festival may be changed and the Festival rescheduled, tickets being valid for the date of the rescheduled events if this is possible, or the Organizer will comply with existing legal provisions at that time with regard to tickets purchased by buyers in case of cancellation of events.
5.23. Moving the venue to the same geographical area or to another nearby geographical area is not a reason to return the value of the tickets.
5.24. The Organizer has no obligation to postpone or cancel the Festival in whole or in part in case of bad weather, but if the authorities request this, the Festival or part of it will be postponed / canceled and the Organizer cannot be held responsible for this aspect.
5.25 The organizer will not be liable in the event of having to postpone / reschedule the Festival for reasons beyond its control, caused by the coronavirus pandemic which make it impossible, difficult or unnecessary to conduct either of the Festivals (including limiting the number of participants in events by state authorities as a measure taken in the context of the coronavirus pandemic) under the conditions planned by the Organizer. In this situation, the purchased tickets / subscriptions will remain valid for the edition at which the Festival will be postponed / rescheduled or the Organizer will comply with the legal provisions existing at the time of postponement / rescheduling with regard to the situation of the tickets purchased by buyers. The organizer will take all necessary measures to properly inform the ticket buyers or interested persons.
5.26 Safety and protection measures. Given the volatility and unpredictability of the way in which the epidemiological situation will evolve, the Organizer will take steps to properly inform all participants and those interested in this event about the protection rules applicable during the Festival.
VI.ACCESS TO THE FESTIVAL
6.1 Entrance to the Festival is possible only through the established places and times, exclusively for the authorized Participants.
6.2 Access to the Festival Area is made only at the specially arranged entrances, in compliance with the procedures for registering the purchased Tickets, the check-in and access rules, provided by the present TCG.
6.3 Access to the Festival Area will be made according to the type of ticket purchased.
6.4 The participants have the obligation that, besides the Ticket, they have identity cards on them.
6.5 At the request of the security team or representatives of the Organizer or other competent bodies or authorities, the Participant has the obligation to present the access documents and identity documents.
6.6 The present TCG will be displayed in a visible place at the entrance to the festival and in other public areas within the festival.
6.7 In order to be allowed access to the Festival area, the holder's access ticket will be scanned at the entrance. After the scan, each ticket buyer who showed up at the entrance to the Festival area receives a bracelet (the color of which depends on the type of ticket purchased). After completing the ticket change process with a bracelet, the bracelet will confer the rights and obligations set forth in the ticket.
6.8 The ticket will be scanned by the employees or collaborators of the Organizer, who will use the infrastructure of the latter.
6.9 The Festival schedule is on Thursdays, Fridays, Saturdays between 5:00 p.m. and 3:00 a.m., and access to the Festival perimeter will be possible from 5:00 p.m. until 2:00 a.m. The Festival program for Sunday is between 12:00 and 18:00, and access to the Festival perimeter will be possible from 12:00 until 18:00.
6.10 The organizer does not give any guarantee regarding the duration of the entry process, given the large number of visitors!
! The bracelets are non-transferable.
6.11 Authorized participants are required to wear the bracelets, for the entire duration of their validity, on the wrist or, in exceptional and duly justified cases, in another visible place, provided that the bracelet cannot be removed without damaging it. The Festival Organizer may inspect the bracelets at the entrance, at the exit and on the entire perimeter of the Festival, throughout its duration.
6.12 Authorized participants are fully responsible for any damage or loss of the bracelet.
6.13 Damaged bracelets, which have been resealed or cut, whose closing system has been opened, those with a diameter larger than the wearer's wrist or which have been interrupted in any way, are NOT valid and the Organizer reserves the right to and to prohibit such persons from entering the Festival, as well as to report the situation to the competent authorities.
6.14 The organizer will only replace damaged or lost bracelets to the extent that the buyer can legally prove the purchase of the ticket / subscription related to that bracelet. The buyer who cannot prove this loses the right to be in the Festival area, and may be denied re-entry to the Festival premises.
6.15 In case of loss or damage of any kind of bracelet, except for the situations mentioned in art. 6.13, will give the authorized participant the right to purchase a new ticket, if he wishes to enter / remain in the perimeter of the Festival.
6.16 If, at the entrance to the Festival area, the ticket holder is suspected of illegally obtaining the ticket, the Organizer expressly reserves the right to ask the ticket holder to present evidence (documents and / or certificates) to verify the acquisition or the legal purchase of the ticket, as well as the right to assess whether it is valid and compliant, and in the absence of proof, he will have the right to refuse entry to the Festival area and report this situation to the competent authorities.
VII. FESTIVAL ACCESS RESTRICTIONS
7.1 In order to ensure the safe running of the Festival, the Organizer reserves the right to restrict the type of objectives and devices that may be brought to the Festival area.
Therefore, it is forbidden to enter the Festival with the following objects:
• Drugs
• Bottles (including perfume or deodorant bottles);
• Cosmetic products (beach cream is allowed);
• Backpacks or bags larger than 29cm x 21cm x 12 cm ;
• Baby bottles;
• Canned beverags;
• Cans;
• Fireworks;
• Lasers;
• Sprays;
• Banners supported by sticks;
• Chairs;
• Knives, weapons, blunt objects;
• Chains;
• Pyrotechnic articles;
• Food or drink;
• Animals;
• Umbrellas (in case of rain it is recommended to use pilgrims);
• Flammable or explosive materials;
• Professional cameras or videos, including any type of DSLR camera or removable lens;
• Any kind of objects that may injure other Participants.
• Access with cars, rollerblades, skateboards, bicycles, hoverboards, or any similar goods in the Festival area is strictly forbidden. This list is not exhaustive, as the organizer has the right to deny access to the festival to the extent that the object held by the participant could endanger the safety of other participants or present danger to the safe conduct of the event.

7.2 Access is allowed with:
• Compact cameras;
• Lighters;
• GoPro cameras;
• Selfie sticks (small in size and made of light materials);
• External batteries.
• Medicine, insulin, drops - medical use, asthma inhaler spray is allowed only if they are accompanied by a medical letter or any other document replacing it and in the maximum amount recommended daily.
7.3 Due to the very strict rules regarding the prohibited objects, the persons responsible for security and monitoring of the Festival will thoroughly search each Participant and any prohibited objects discovered after the verification will be stopped at the gate, without the Organizer assuming responsibility for them.
7.4 All Participants are advised to consult the list of prohibited objects and not to hold such objects in the Festival.
7.5 Regarding the lost objects, the Organizer will arrange a special space where such objects can be brought and from which each owner can recover his goods within 72 hours, but not later than the first day after the Festival ends – time 10:00 AM.
7.6 The organizer has the possibility, but not the obligation, to photograph the lost objects and to expose them on social networks, as the case may be, insofar as this action would not violate the legal norms regarding the protection of personal data.
7.7 After the first day after the end of the Festival, at 10:00 AM, all unclaimed items will be handed over to their issuers (for example: identity card, birth certificate, etc. to the attention of the Municipal Police; bank cards to the issuing bank’s attention). Objects without identifiable issuer, regardless of value, will be donated for charitable purposes, as far as possible and depending on the nature of the objects.
7.8 The Organizer is not responsible for the goods of the Participants or for any damage caused to them.
7.9 For the safety and/or the convenience of the participants, the organizer reserves the right to temporarily stop access to certain areas, if he considers that the areas have reached their maximum authorized capacity.
VIII.MINORS AND PERSONS WITH DISABILITIES
8.1 The consumption of alcoholic beverages, cigarettes and drugs is forbidden to minors.
8.2 Minors will receive Wristbands of a different color, which will allow them to be easier to identify.
8.3 Minors under the age of 7 have free access to the Festival, in the company of a parent, and it is recommended to be done by 19:00. At the request of the persons responsible for security and monitoring, as well as the Organizer's representatives, the companion has the obligation to present documents such as: student card, passport or any other document that contains the minor's photo, certifying his age.
8.3.1 The access of minors between 7-14 years old is made only on the basis of a valid Ticket, identity document, declaration of commitment and only in the company of a parent.
8.3.2 A parent may accompany a single minor under the age of 14 years.
8.3.3 An adult is required to assume responsibility for a minor and is required to complete and sign the “Declaration of Commitment” available at www.bemassif.com,, without which the child will not be allowed to enter the Festival Area, regardless of whether or not he has an attendant.
8.3.4 The access of minors between 14-18 years old will be done only on the basis of a valid Ticket, identity document and declaration of commitment.
8.3.5. The responsible person will provide contact details in the declaration of commitment where he can be contacted in case of emergency.
8.4 The Organizer assumes no responsibility regarding the verification of signatures, respectively the way of signing the declarations, these aspects remaining in the burden / responsibility of the persons presenting the statements.
8.5 In some areas of the Festival, the access of minors under 18 is strictly forbidden (for example : VIP area).
8.6 Due to the very loud noise produced during the Festival, the Organizer does not recommend the presence of children under 7 years old at the Festival. Minors under 4 years old must wear antiphonal headphones.
8.7 Exceptional situations when discounts / gratuities are granted to a certain category of minors or other Participants, will be reported on the site (eg. e-Tickets), and are sent to you as an attached PDF in an email that each Participant has the obligation to print it out and bring it with you to the event, or present the ticket in electronic format (on your phone, tablet or other electronic devices that allow this) when you check in at the location.
8.8 In the case of people with disabilities in a category of disability and their companions, they benefit from the following facilities up to 50 subscriptions:
children with disabilities and their companions receive a free subscription for the Festival.
adults with severe disabilities and their companions receive a free subscription for the Festival.
8.9 In order to benefit free of charge, adults with disabilities (or in the case of minors, their legal representatives) must send a request to express their wish to participate in the festival and fill a declaration on their own responsibility, with the classification in the degree of disability, and sent it at ask@wintermassif.com. If the persons with disabilities will receive a subscription, they will receive an email form the Organizer for this purpose. These persons are subsequently obliged to present in the original, in the access point mentioned in the confirmation email received, the certificate of classification in the degree of disability and the identity card for validation.
8.10 The free access of persons with special needs is made only on the basis of the identity document, the certificate of inclusion in the degree of disability and the confirmation received by email from the Organizer.
8.11 Incomplete application and / or requests sent to other email addresses will not be considered.
8.12 The Organizer reserves the right to refuse access to the festival for persons with disabilities who do not present these documents in the original, as well as if the representatives of the Organizer have justified doubts about the validity or authenticity of the presented documents.
8.13 The registration period in order to benefit from the gratuity for the 2024 edition, provided in art. 8.8 is 01.12.2023 – 01.02.2024. All requests submitted outside this period will not be taken into consideration.
8.14 Taking into account that this facility can only be granted within a limited number of places, taking into account the total capacity of the Festival as well as the safety and security norms, the gratuity will be granted according to the order of receipt of the applications.
8.15 At the time and to the extent that the number of applications that meet the conditions specified above is reached, the Organizer will publicly communicate to interested persons that the maximum number of free tickets for people with disabilities has been reached, and from that moment the Organizer will not respond to requests to this effect.
8.16 The organizer will respond to these requests within 30 days from the date of formulating the requests.
8.17 People with a severe disability assume the obligation to always be accompanied by another person at the Festival, for reasons of personal safety.
8.18 The Organizer will not be held responsible for any incident or accident concerning minors or persons with disabilities. The entire responsibility for them belongs to minors / persons with disabilities and / or parents / legal representative or caregiver.
8.19 The Organizer draws the attention of the parents / legal representative or persons exercising parental authority to the fact that they have the obligation to supervise the minor and will be held liable for any damage resulting form non-compliance with this obligation.
8.20 In the attention of people with locomotor problems, who use a wheelchair for traveling: only certain areas of the Festival are provided entrances with wheelchair facilities, these being marked on the Festival map.
IX.BEHAVIOR DURING THE FESTIVAL
9.1 In the Festival Areas, visitors have the obligation to refrain from all actions, statements or behavior that may endanger the life, health or physical integrity of other persons or which may violate their personal rights.
9.2 Any form of economic, commercial or advertising activity in the Festival Area – including in the area in front of the Festival gates – is prohibited without the prior written permission of Massif. If the Organizers find that such activities are carried out within the scope of the festival, they reserve the right to remove the persons concerned and to prohibit their access to the festival.
9.3 The sale of alcoholic beverages must comply with the provisions of the law, and so such drinks may be offered to minors under the age of 18 and to persons who are intoxicated by any seller within the Festival. The organizer’s Business Partners will serve drinks (soft drinks or alcohol) exclusively in open containers (aluminum or plastic).
9.4 The use of substances qualified as drugs is banned in the festival area and is punishable by law. The organizer reserves the right to cut and deactivate the wristband of the participant who violates this provision, to remove him from the festival perimeter and to no longer allow him access, requesting the intervention of the competent authorities.
9.5 The Organizer reserves the right to introduce a system at the Festival where alcohol can be offered to the Visitors only if the Visitor concerned presents a certifications or an act stating that he has the right to consume alcohol (e.g the identity card certifying his age).
9.6 Any demonstration of any kind, not related to the Festival organized by the Organizer, regardless of the number of participants, is prohibited, unless the Organizer has given prior written approval in this regard. This approval is granted by the Organizer at his free choice, based on the prior request of the organizer of the respective demonstration. If an approval is obtained, the participants are obliged to comply with the present TCG and to behave in a way that does not disturb, prevent, limit or make the entertainment of other ability to exit the Festival area, as well as the use of Services and / or Products by other Visitors.
9.7 The Organizer has the right to terminate the demonstration (both those authorized in accordance with the above and those not expressly authorized). Without giving a reason in this regard Massif has the right to determine the conditions of the demonstrations, in particular the number of participants, their location and duration, at their free choice. If the Organizer declares the conclusion of a particular demonstration, participants are obliged to immediately stop the demonstration. If the Organizer sets conditions for an authorized or recognized demonstration as described above, participants are required to fully comply with these conditions.
9.8 In the Festival Area, authorized and appropriately qualified employees of the Organizer or its Contracting Partners, as well as the employees or partners of the Partners, will ensure the application of the rules of conduct and safety. Visitors are expressly committed, by virtue of their participation in the respective Festival, that they will fully cooperate with these persons within the limits of the law and will respect their instructions during the Festival in case of emergency or if other significant circumstances (e.g for reasons of public health) justify it.
9.9 The Festival can use both Free Services and Products and Services and Products for which payment is received. Visitors are obliged to pay all the Services and Products for which payment is received and assume the responsibility for the immediate payment of all prices and purchase fees due.
9.10 Authorized participants will pay for the products and services for which payment is charged using the payment methods provided by the Organizer or the contractual partners according to TCG.
X.VIDEO SUPERVISION AND PROCESSING OF PERSONAL DATA
10.1 For security reasons, the Festival Area is supervised with video cameras by the Contracting Partners of the Organizer. The processing of your personal data taken over the surveillance video cameras takes place whenever you are in the Festival, and by participating at this Festival the Participant explicitly gives his consent for this processing. Also, the concerts as well as the entire festival can be video recorded or photographed by our contractual partners, for marketing and advertising purposes, as mentioned in Chapter XIV.
10.2 The categories of personal data processed, the means, the purposes of the processing, as well as the entire policy of the Organizer regarding the processing of personal data are found in the Privacy Policy of the Festival available on www.bemassif.com in the Privacy Policy section that can be accessed on the www.bemassif.com website..
10.3 According to the EU Regulation 679/2016 (GDPR) individuals can exercise the following rights: the right to be informed, the right of access, the right to rectification, the right to erasure, the right to restrict processing, the right to data portability, the right to object to processing, the rights in relation to automated decision making and profiling.
10.4 If personal data which have been processed in accordance with this Regulation and the legislation in force are subject to change or if the holders of such data find that the data we hold about them are incorrect, they may request that they be amended. by sending a dated and signed letter to the email address: ask@wintermassif.com or by postal services to: MASSIF ESTATE SRL, based in Cluj-Napoca, 122A Eremia Grigorescu Street, Cluj County. If the person who contacts the Organizer is dissatisfied with the answer received from him, he can address the National Authority for the Supervision of Personal Data Processing - based in Bd. Gheorghe Magheru, no. 28 - 39, Bucharest.
XI.PRODUCTS AND METHOD OF PAYMENT WITHIN THE FESTIVAL
11.1 In the Festival area there will be points from where the authorized participants can obtain the products and services provided by the Organizer or its contractual partners.
11.2 The participants have the obligation to use in the Festival area only the payment methods and tools established by the Organizer with which they can purchase the products and services available during the Festival.
11.3 The payment methods for the Products and Services offered in the Festival area are: multi-use vouchers used through payment devices (RFID), provided by the Organizer, through the Festipay service, respectively the Bracelet. These payment instruments are considered MPVs (multi-purpose vouchers), as defined by the European Commission, due to the fact that in exchange for credit points on the payment instrument, the participant can purchase services / products that have a share Different VAT. In this case, the collection of VAT is made when using credit points.
11.4 The method of purchasing RFID, charging the bracelet, respectively the procedure regarding the transactions in the electronic system during the Festival are the following:
Upon entering the Festival area, each participant will receive a bracelet (with the integrated payment system);
after receiving the bracelet, it is recommended that each participant goes to one of the Credit Points installed inside the Festival to charge their bracelet with credit points. This is a service offered by the Organizer to authorized participants, which involves the action by which a participant can allocate a certain amount of money on the Festival bracelet, and this amount will be spent only during the Festival and within it.
Participants have the opportunity to charge their bracelet as many times as they want. (Re)Charging the bracelet can be done: in cash (only in RON (lei)!) or by bank card (only in RON (lei)!): The balance of the bracelet / card can be (re) charged with any amount desired by participant in cash, only in the currency RON (lei) The maximum value of a single (re) upload is 10000 RON and the minimum is 5 RON The first payment made with the bank card will require the 3D Secure security code.
If the first payment is authorized, subsequent payments may be made without the 3D Secure Security Code. Complaints about how to charge in this regard can only be made at the point of (re) charging immediately after (re) charging (ie immediately after the transaction, if the difference can be clearly determined). After leaving the (re) loading point, no further complaints will be accepted. The staff will issue the proof of loading for the operation of (re) loading the bracelet (digital wallet).
The conversion for this MPV (multi-purpose voucher) is: 1 leu - 1 credit point.
For each upload, the Organizer has the opportunity, but not the obligation, to hand the participant a proof of the amount deposited on the bracelet.
11.5. The bracelet will be the only payment method during the Festival. Payment by cash / bank card in the Festival area is strictly forbidden, outside the credit point areas previously established by the Organizer.
11.6 The organizer has the opportunity to provide participants with proof that the transaction (deposit or withdrawal of funds) has taken place.
11.7. Damaged bracelets can be deactivated and replaced with other bracelets at the Help Desk - Credit Point, located in the Festival area throughout the Festival, taking into account the provisions of art. V. After obtaining a new bracelet from the Help Desk - Credit Point, the amount owned by the participant on the damaged bracelet will be transferred to the new bracelet.
11.8. The participant has the right and the possibility to check the amount available on the bracelet at any contractual partner in the Festival area or at the credit point.
11.9. Purchase of products / services from merchants (contractual partners):
The participant chooses the desired Product, at which point the respective contractual partner ticks the amount in POS;
Each participant has the obligation to check the amount checked by the contractual partner in POS, and after verification will touch the face on the bracelet of the POS (contactless card-reader) terminal to make the payment;
The contractual partners will have the obligation to issue tax receipts to the client participants (and invoices, at the request of the participants). If a participant wants a tax invoice for the products / services purchased during the Festival, he has the obligation to keep all tax receipts from each trader (contractual partner) in order to subsequently request the tax invoice from those contractual partners.
XII.REFUND - Refund of the money left unspent on the Wristband, at the end of the Festival
12.1 REFUND is the action by which an authorized participant recovers the money left on the bracelet, until the end of the Festival, under the conditions detailed in T.C.G.
12.2 The unused amounts on the RFID bracelet can be exchanged for cash, through the process called REFUND, only at the location of the Festival in the charging points of the bracelets (Credit Points) if all the conditions imposed by the Organizer are met, respectively:
respecting the deadline for requesting the refund: The return of the amounts can be requested at any time during the Festival, but at the latest until 18.03.2024, between 12:00 AM and 18:00 PM. The participant can also request the donation of the amount by filling in a form at the same location. Any request after the date and time expressly indicated will not be considered by the Organizer. In this situation, the Organizer will not be held responsible for the refund of the amount to the participant, being his duty and exclusive obligation to comply with the date and time until which he can request a refund / donation of unused amounts on the bracelet. If the participant does not make the request within this period, he is solely responsible for the non-refund of the money, the Organizer being free from any fault. After the mentioned term, these amounts become the property of the Festival. IN THIS SENSE, WE RECOMMEND THE FESTIVALS TO REQUEST THE REFUND AT THE LATEST WHEN THEY LEAVE THE FESTIVAL, ON THEIR LAST DAYS OF PARTICIPATION.

XIII.HEALTH AND SAFETY
13.1 Given the size of the Festival, the Organizer shall take the appropriate measures so that the Participant are informed on the prevention and protection measures and activities in the Festival Area.
13.2 Everyone must behave in a civilized manner towards the other Festival Participants.
13.3 To the extent that the Organizer considers that a participant endangers the safety of other participants or creates a situation of discomfort for them or behaves in a manner that affects the smooth running of the Festival or the atmosphere of the Festival, the Organizer reserves the right to cut the bracelet of the participant and to request the assistance of the public authorities or security company to escort that participant out of the Festival and to prevent his subsequent access to the Festival. In this case, the participant will not have the right to request a refund of the ticket value or any other compensation.
13.4 Government agencies, institutes or other authorized bodies may give the Organizer negative advice regarding the access of a ticket and/or subscription holder to the Festival. In this case, the Organizer is entitled to refuse entry to the event perimeter of the Buyer, and the latter will not have any right to compensation.
13.5. Participants acknowledge the potential risk of contracting COVID-19 (or similar). The organizers will not guarantee that the Festival area is or will remain entirely free of COVID-19 (or similar). Entrants assume full responsibility for any loss or damage incurred in connection with COVID-19 (or similar).
XIV.RECORDINGS CARRIED OUT WITHIN THE FESTIVAL
14.1 By purchasing a ticket and by attending the Festival, the Product Buyer agrees to be photographed, filmed or recorded by the Organizer, venue management or any third party operating on behalf of the Organizer within the Festival or in the immediate vicinity of the entrance to the venue. In addition, by purchasing a Product, the Product Purchaser consents to photographs, video or audio recordings of you at the Festival or in the immediate vicinity of the entrance to the venue ("Filmed Material") taken by the Organiser, venue management or any third party operating on behalf of the Organizer. You hereby agree that the Promoter, venue management or any third party acting on behalf of the Promoter may use the Recorded Material in any way they see fit without restriction, approval or reward for doing so.
14.2 Visitors acknowledge that the Organizer, its contracted Partners as authorized by the Organizer, associates, members of the press, other Visitors and other Third Parties may produce sound and image recordings of the Festival.
14.3 The organizer may use photo and video images of the participants, made by its own employees, its service providers, contractual partners and other authorized third parties in various materials made on the occasion of the Festival or for the purpose of promoting it.
14.4. The participants by virtue of their participation in the festival, grant to the Organizer as well as to all those authorized by him the express permission for the registration and publication of the image, appearance and actions within the Festival on its perimeter.
14.5 The Organizer, the contractual partners, the authorized suppliers of the Organizer, the members of the press and other third parties authorized by the Organizers may and have the unrestricted right to use, copy, publish, make public, distribute and distribute in particular for the promotion of the Festival. images and photos taken with festival participants, without having to pay the latter any remuneration for their use.

14.8 Participants have the right to make audio / photo / video recordings of the Festival for personal use. Participants do not have the right to sell images / photo-video recordings from the Festival without the prior consent of the Organizer.
14.9 Participants acknowledge and expressly agree that the Organizer may record the Festival, concerts and any entertainment, copy the recordings and distribute them by any means, broadcast or make them public in any way it wishes, without limitation. in time or space, and these recordings may contain photo or video images of the participants.
14.10 The participants do not have the right, within the limits of the legal provisions, to raise claims against the Organizer in connection with their recordings and publication, as provided above.
14.11 The organizer reserves the right to establish areas / locations with prohibited photography / filming. In case of non-compliance, the Organizer has the right to delete those records.
XV.INTELLECTUAL PROPERTY RIGHTS
15.1 The content, activities, artistic and organizational concepts, internal work procedures and the like (information, data, images, texts, symbols, graphics, web design elements, programs and the like) are the property of the Organizer and are protected by applicable laws. on copyright protection.
15.2 The use of any of the aforementioned elements, as well as any other similar elements that can be assimilated to copyright, without obtaining the prior written consent of the Organizer is punishable by law.
15.3 Reproduction in whole or in part, modification, transfer, distribution, republishing, copying in whole or in part of the content of the Festival is not permitted without the prior written consent of the Organizer.
15.4 Personal data are exceptions to the above and are treated separately in their content.
15.5 Everything that is posted on the Site as well as on various types of media in the Festival area, such as, but not limited to, images, texts, graphics, symbols, logos, databases, etc. is the property of the Organizer and / or its Contractual Partners. All of this is covered by intellectual property law.
15.6 Participants may not use, copy, distribute, publish or incorporate in other documents or materials any concept, information, data, documents or procedures (see art.15.1) for the purpose of obtaining revenue without the prior written permission of The organizer and / or his contractual partners.
15.7 The images, logos, brand, texts or any other information or document belonging to the contractual partners of the Organizer belong to them and are reproduced on the site or in the Festival area with their consent.
XVI.SUPPLY OF INFORMATION/FRAUD TENTATIVES
16.1 In order to use the Website, the Website users agree to provide accurate information on themselves, as specified in the user registration section, and agree to provide this information correctly and completely.
16.2 Any attempt to provide false information, to access the personal data of another user, to amend the Website contents or to affect the performances of the server hosting the Website shall be considered an attempt to fraud the Massif systems and shall lead to immediate blocking of Website users’ access. Also, Massif reserves the right to inform the competent authorities of this attempt.
XVII.PROMOTIONAL OFFERS, TABLES AND COMPETITIONS
17.1 The Organizer, at its sole discretion, shall determine the conditions for carrying out promotions on the Website, under the law. The promotions, raffles and competitions shall be carried out for a limited period and shall expire automatically on the date indicated for each and every promotion, raffle or competition.
17.2 Any promotion, raffle or contest may be discontinued or canceled at any time without prior notice. However, all participants will be notified of the interruption or cancellation.
XVIII.DISPUTES
18.1 These Rules, as well as any disputes in connection with or arising out of its terms or participation in the event, will be settled amicably by Participants, Volunteers, Partners, Third Parties and Organizers.
18.2 If this is not possible, the settlement of disputes is the responsibility of the Romanian courts in the locality where the Organizer has its registered office.
XIX.FINAL PROVISIONS
19.1 The name of the chapters and the sub-titles are for reference only and should not be taken into account in the interpretation or construction of these T&Cs.
19.2 By participating in the Festival or by accessing the MASSIF ESTATE brand communication channels, especially the website www.bemassif.com, the users confirm that they have read, understood and accepted the present T.C.G.
19.3 If any of the clauses in this T&Cs are declared null and void, the rest of the clauses will continue to produce their effects, and the clause declared null or unenforceable will be replaced by a new clause that reflects as closely as possible the will of the Organizer.

1.1 Privacy of personal data represents one of the main concerns for MASSIF ESTATE SRL. As such, we aspire to provide the highest standards of privacy and transparency for the personal data we’re processing in our current activity.
1.2 Since for conducting our business we are required to process a series of personal data, especially in relation to the specifics of our line of business, we wish to provide assurances that the processing will take place in compliance with the principles of transparency and security of personal data. This privacy policy is meant to help you understand what data we’re collecting, why we’re collecting it and what we’re doing with it.
2. Who are we?
2.1 MASSIF ESTATE SRL is a Romanian company, established in Cluj-Napoca, Eremia Grigorescu, nr. 122A, registered with the Trade Register under no. J12/5924/07.12.2021, VAT number: RO36944344. MASSIF ESTATE SRL acts as operator of personal data collected through the www.bemassif.com website (the "website”), the ticket buying process by the buyer, the means of video monitoring and photo and video image capture within the Festival by persons authorized by MASSIF ESTATE SRL.
2.2 The operator is required to manage safely and solely for specified purposes, the personal data that the users of the website are providing.
3. What kind of data is processed, the purpose of processing and the storage period for and the legal basis for processing for each category of data?
3.1. For the purpose of purchasing a MASSIF product or service.
What data do we process? Name, surname, e-mail, phone, country, town, address.
Storage period: Until the end of the general prescription period of 3 years from the completion of the edition in which the ticket was bought or the edition about which the respective problem was reported.
Legal basis for processing: Art. 6 (1) letter b) - the processing is necessary for the execution of a contract to which the data subject is a party or to take steps at the request of the data subject before concluding a contract.
3.2. For the purpose of returning purchased products or solving a problem addressed to us.
What data do we process? Name, surname, e-mail, telephone number, IBAN and name of the account holder, as well as other information provided by e-mail or on other platforms to describe the problem.
Storage period: Until the end of the general prescription period of 3 years from the completion of the edition in which the ticket was bought or the edition about which the respective problem was reported.
Legal basis for processing: Art. 6 (1) letter b) - the processing is necessary for the execution of a contract to which the data subject is a party or to take steps at the request of the data subject before concluding a contract.
3.3. In order to ensure access to the perimeter of the festival and to provide the services to which the participant is entitled based on the ticket, to inform about the aspects related to the organisation and conduct of the event or any other offers and announcements related to the purchased product, to prevent fraud , abusive use and to check the validity of the ticket or subscription.
What data do we process? Name, surname, e-mail, phone number and ticket / wristband number for access to the festival.
Storage period: The data will be anonymized within 3 years from the last edition in which the person concerned participated in the Festival, if this was not previously requested.
Legal basis for processing: Art. 6 (1) letter b) - the processing is necessary for the execution of a contract to which the data subject is a party or to take steps at the request of the data subject before concluding a contract.
3.4. For internal purposes only, to carry out reports and surveys, organise access areas, create campaigns and dedicated activities, to respond to a request from public authorities, for complaints or complaints.
What data do we process? Sex, country, city, county, date of birth.
Storage period: These data are kept in the Organizer's archive without being associated with a natural person following the irreversible anonymization of personal data.
Legal basis for processing: Art. 6 (a) letter f) the processing is necessary for the purposes of the legitimate interests pursued by the operator or a third party.
3.5. For marketing purposes:
3.5.1. For commercial purposes promoting Massif products and services.
What data do we process? Name, surname, email address, phone number.
Storage period: Data will be anonymized upon withdrawal of consent or within 4 years at most if the data subject no longer reacts to any commercial message.
Legal basis for processing: Art. 6 (a) letter f) the processing is necessary for the purposes of the legitimate interests pursued by the operator or a third party.
3.5.2. In order to carry out surveys to improve the quality of the services we offer, telephone calls may be recorded with the consent of the person concerned.
What data do we process? Voice of the subject.
Storage period: Recorded calls will be deleted within 30 days from the time of recording.
Legal basis for processing: Art. 6 (1) (a) the data subject has given his consent for the processing of his personal data for one or more specific purposes.
3.6. In the REGISTER CAMPAIGN:
3.6.1. For the purpose of registering in the Register Campaign where the persons concerned register in a community where they receive recurring information about the latest promotions, campaigns, announcements, sales of tickets at a promotional price at the Massif Festival editions.
What data do we process? Name, surname, email address, phone number.
Storage period: Data will be anonymized upon withdrawal of consent or at most within 4 years from the last edition in which the person registered for the campaign. If the persons concerned bought a Ticket in this campaign, their personal data will be processed from this step forward in order to be able to ensure the purchased services and access to the Festival.
Legal basis for processing: Art. 6 (1) letter b - the processing is necessary for the execution of a contract to which the data subject is a party or to take steps at the request of the data subject before concluding a contract.
3.6.2. For internal purposes only for making reports and surveys, organizing artistic moments, creating the concept of the annual event, creating campaigns and dedicated activities.
What data do we process? Sex, country, county, date of birth.
Storage period: These data are kept in the Organizer's archive without being associated with a natural person following the irreversible anonymization of personal data.
Legal basis for processing: Art. 6 (a) letter f the processing is necessary for the purposes of the legitimate interests pursued by the operator or a third party.
3.7. In order to ensure the security of goods, premises and people, video monitoring means are used in the perimeter of the festival.
What data do we process? Image of visitors from the event.
Storage period: 20 days. Some data may be retained for a longer period if the retention is necessary for the investigation of fraud, for the defense of the rights in court of any of the Parties or in situations where it is necessary to comply with the requests made by the competent authorities.
Legal basis for processing: Art. 6 (a) letter f the processing is necessary for the purposes of the legitimate interests pursued by the operator or a third party.
3.8. To take photographs and videos during the event, subsequently used for journalistic, informational, commercial, marketing and promotion purposes of the event, Massif products and services or adjacent products and services, in its own name by Massif or by any partner or sponsor of the Massif Festival, as well as for the purpose of making NFT (Non-fungible token) and trading them on the relevant market.
What data do we process? Image of visitors from the event.
Storage period: Until the deletion request from the data subject or no more than 15 years from the time of completion of the edition in which they were made.
Legal basis for processing: Art. 6 (a) letter f the processing is necessary for the purposes of the legitimate interests pursued by the operator or a third party.
3.9. For the purpose of organising promotional campaigns and contests, as well as to ensure the sending of prizes.
What data do we process? Name, surname, e-mail, social media profile (if applicable), information included in comments in campaigns organised by the Organizer or in partnership with other partners.
Storage period: Until the expiry of the general limitation period of 3 years from the end of the campaign or contest.
Legal basis for processing: Art. 6 (a) letter f the processing is necessary for the purposes of the legitimate interests pursued by the operator or a third party.
3.10 In addition to the aforementioned purposes, we process the personal data collected for the following purposes:
For the fulfilment of legal obligations, as a result of the services provided (e.g. accounting, fiscal, audit, etc.), these are always compatible with the main purposes, for which the data was collected.
To the extent that the data subject has given their consent for the processing of their personal data for one or more specific purposes.
For any other purpose auxiliary to the above, or for any other purpose for which we have been provided with personal data, in compliance with the relevant legislation.
To protect our legitimate interests, overriding the interests or rights and fundamental freedoms of the data subject, taking into account their reasonable expectations based on the relationship with the operator:

3.11. In the situations in which we will use your data for purposes other than those mentioned in this Policy, we undertake to obtain your consent, unless we have a legal obligation or have a different legal basis for processing the data.
3.12. The Controller does not create individual profiles for those who participate at the Massif Festival.
4. How are we collecting your personal data?
4.1 We are collecting your personal data either directly from you, e.g. when you’re creating an account on our website/App, you’re sending us an e-mail at ask@wintermassif.com, in which you’re requesting us an offer / information, and you’re giving your consent for communication of commercial messages, , etc., or indirectly, e.g. when you’re sending this information to the platforms of other collaborators for our company, in the process of purchasing the ticker/pass.
4.2 We collect your personal data automatically, when you use our services from the website, we collect information through cookies and by logging your activity. For more information on the use of cookies, please refer to Art. 6 of this Policy.
4.3. If you choose to provide us with the personal data of others, such as when you purchase tickets on behalf of others, you are responsible for how you obtained these data and that you have a legal basis for processing them. We cannot be held liable for the violation of the rights of the respective persons.
5. How are we storing the personal data?
5.1 For storing the personal data you're providing as a user of our website / App, a cloud service provided by Amazon Web Services EMEA S.A.R.L. is used.

• you objected to the processing and request restriction while we check whether it receives our legitimate interest for the processing.
9.3.6. The right to data portability

9.3.7. The right to opposition
At any time, the data subject has the right to object, for reasons related to the particular situation in which he is, to the processing. We will make every effort to respond to your request within 30 days. This period can be extended due to reasons related to the specific legal right invoked or the complexity of your request with a maximum additional period of two months. In any case, if the legal response deadline will be extended, then we will inform you about the new deadline and the reasons that led to this extension.
10. Information security
10.1 We are working hard to protect our website, App and users, as well as all personal data collected in accordance with this Policy, from any unauthorized access or from the modification, unauthorized disclosure or destruction of the information we hold.
10.2. In this regard:
MASSIF ESTATE SRL certifies that it meets the minimum requirements for the security of personal data, the data being processed in a way that provides protection against unauthorized or illegal processing and against accidental loss, destruction or damage, by taking appropriate technical or organizational measures;
or the data collected through the website and the App, in order to ensure access to the festival, MASSIF ESTATE SRL uses a cloud service provided by Amazon Web Services EMEA SARL. Therefore, the security settings provided by Amazon are used. Access to data is done in a whitelist of security groups, which means that data can only be accessed from certain pre-defined IP addresses. Access is based on username and password, and within MASSIF ESTATE SRL access to the database is allowed to a limited number of persons.
The used data storage systems have implemented back-up mechanisms to ensure the redundancy of the stored data.
We are regularly reviewing the practices for collecting, storing and processing information, including physical information, as well as security measures, to prevent unauthorized access to the systems.
We are restricting the access of our employees and contractors to your personal information, and the contractual relations with these persons are subject to strict rules regarding contractual confidentiality obligations, including under the sanction of termination of contracts.
11. When does this Privacy Policy apply?
11.1. Our privacy policy applies to all services offered by our company and excludes services that have separate privacy policies and do not contain the provisions of this privacy policy.
